Understanding "Discovery" - Sharing Information in the Probate and Family Court has
information about the process of "discovery," which is the means by
which the parties in a court action gather information from each other
so that they can build a stronger case and improve their chances of
getting the Court to order what they are looking for. Discovery makes
it possible for you to gain access to information and documents in the
possession of the other party. It also makes it possible for the other
party to gain access to information in your possession. This article
also has information about "mandatory disclosure," a procedure under
which parties are required to give information to each other without
having to ask for it. In some cases you will not need to perform
discovery beyond what is required by mandatory disclosure. In others,
it will be important to your case. Discovery is especially important
