How to Answer a Complaint in Probate and Family Court
If you get a Summons and Complaint that says you have to answer by a certain date, you are the "defendant" in this case. The person who filed the Complaint is the "plaintiff." The Complaint tells the court and you what they want the court to do. They put their reasons in their Complaint. In your Answer, you respond to the Complaint.
An "Answer" is your answer to the complaint that the plaintiff filed. When you file your Answer with the court, you tell the court, in writing, the statements in the Complaint that:
- You agree with,
- You disagree with, and
- You do not know about.
When you go to court, you can explain each point in more detail.
